TERMS & CONDITIONS OF BOOKING
1. TO CONFIRM YOUR BOOKING All bookings will be provisionally held for seven days until either the required deposit or full payment is received. A non-refundable deposit of 25% of the total rental price for the period booked is required, along with a completed and signed rental agreement. Any balance due must be paid in full no later than six weeks before departure, except where the departure date is less than 6 weeks after the booking date in which case full payment is due within 7 days of booking. If payment is not received within 7 days of booking or if balance payments are not received by the due date, we reserve the right to cancel your booking. Receipts will be issued by email for deposit and balance payments. Your booking is confirmed once cleared funds are available in our bank account. In the event of a payment not being honoured by the bank on which it is drawn, a £20 charge will be levied to cover administration costs and bank charges. Amendments to the rental agreement can only be made with the agreement of Alicante Holiday Villas Ltd.
2. KEY COLLECTION AND DIRECTIONS Provided that full payment has been made and your payment has cleared, precise directions to the property and key collection instructions will be issued no later than seven days before departure, except in the case of late bookings when details may be issued up to the day of departure.
3. CANCELLATION In the event that you cancel your booking for any reason whatsoever, the following charges will apply. Up to six weeks before departure – deposit only. Within six weeks of departure – 100% of the full rental cost. If for any reason during your stay you decide to cancel your booking, no refund will be issued. If, during your stay, you wish to be moved to alternative accommodation Alicante Holiday Villas Ltd will endeavour to locate suitable alternative accommodation (subject to availability). Any additional cost including additional rental charges, cleaning charges, taxis, or any other associated costs will be at the expense of The Renter - unless there is a major fault with the original property booked, such us prolonged interruption of electricity, gas, water or other major problem. In the unlikely event of cancellation by an owner, or should the property become uninhabitable prior to your stay, a full refund of the cost of your holiday rental accommodation, paid at the time of cancellation, will be given plus the relevant amount of the security deposit, if alternative accommodation is not available. Under no circumstances shall Alicante Holiday Villas Ltd's liability to the guest exceed the amount paid to Alicante Holiday Villas Ltd for the rental period.
3a DISRUPTION DUE TO VOLCANIC ASH If your outbound flight is cancelled and you are unable to travel on the expected date, we ask that you contact us immediately. We will endeavour to move your reservation to alternative dates in the same property, subject to availability. Additional charges apply should your revised dates fall in a higher price band. If we are unable to accommodate you in the same property you may make a new reservation in an alternative property, subject to availability, however the cost of the new reservation must be paid in full. If you decide not to travel no refund, apart from the security deposit, will be due.
If your return flight is cancelled and you are stranded until a later date we will, where possible, organise alternative accommodation in an Alicante Holiday Villas property. Additional charges, pro rata to the applicable weekly rate, apply. If we cannot organise alternative accommodation you will have to leave the reserved accommodation on the agreed date and contact your airline.
We strongly advise you have appropriate travel insurance.
4. WHAT'S INCLUDED Your holiday home rental includes: accommodation and all facilities, including water, electricity (unless otherwise stated), gas etc, the use of the communal pool or pools designated to the property, bed linen, bathroom towels and a full clean before arrival. Not included in the price are flights, car hire, airport transfers, travel insurance, mid term cleaning and/or linen changes, meals or the hire of cots or associated items unless stated otherwise in the property details.
5. SECURITY DEPOSIT A security deposit is charged on all bookings. This is held against any loss or damage during your stay. Any accidental or wilful damage or loss to any property and/or its contents are the responsibility of The Renter and must be reported to the owner's keyholder. Deductions will be made from the security deposit to cover the cost of any damage to, or loss from, any property or should any additional cleaning or removal of rubbish be required at the end of your stay. An administration fee of £15.00 may also be charged. Subject to no claim being due, the full amount will be refunded no later than 21 days from the conclusion of the rental period.
6. CURRENCY We trade in £ Sterling only. It is the responsibility of The Renter to ensure that any bank charges and/or exchange rate fluctuations are taken into account when making payments in currencies other than £ Sterling.
7. RENTAL PERIOD Access to any property is from 3pm onwards on the day of arrival. Properties must be vacated by 10am on the day of departure. It may be possible to alter these times in individual cases. Additional charges may be incurred. We welcome rental periods of any number of nights, however stays of less that seven nights will be charged at the full weekly rate appropriate to the month of the year. Stays in excess of seven nights will be charged at the weekly rate plus the pro rata nightly cost.
8. SECURITY AND SAFETY The directions to the property will contain instructions to ensure each property is kept secure during your stay. In addition the owner or the owner's keyholder may include further instructions in any of the properties. It is the responsibility of The Renter to ensure these, in addition to any reasonable security measures, are carried out. Any loss or damage to or from any of the properties occurring as a result of a failure to follow any or all security instructions or through negligence is the sole responsibility of The Renter. Further it is The Renters sole responsibility should failure to follow any or all security instructions, or reasonable security measures, result in injury, illness, loss or damage to any member of the travelling party or their personal property or that of the accommodation owner. We take the safety of our guests very seriously. Unfortunately crimes against people and property are a fact of life throughout the world and you have the same responsibility for your personal safety as you do at home. We therefore advise all guests to be extra vigilant and ensure that great care is taken of your personal property, the accommodation and its contents and, if grilles and/or shutters are fitted to doors and windows please ensure these are closed/locked when leaving the property or in the garden or on the roof terrace. In the event that you should lose any items of value while on holiday through theft or otherwise, you must report the facts immediately to the local police and obtain a written report. If a report is not obtained, it will be difficult for you to pursue any claim through your holiday insurance.
9. KEYS One set of keys will be issued per property. It is The Renter's responsibility to take good care of the keys issued. If the keys are lost, mislaid or stolen all the locks to the property will be replaced. The cost of the replacement locks and keys will be borne by The Renter in all circumstances and this will also include the cost of replacing keys/electronic fobs to the urbanisation, swimming pool and/or garage.
10. OVER OCCUPANCY The size of the travelling party is as stated on the booking form. If the actual number of persons exceeds the number stated admission to the property may be refused. In this instance no refund whatsoever will be given. If, during the course of your stay, additional people are resident over and above the number stated on the booking form the security deposit will not be refunded and additional charges may be incurred.
11. AGE RESTRICTION & GROUPS We cannot accept bookings from groups of teenagers, large single sex groups, groups where the majority are 21 years of age or under, or from hen and stag parties. Groups of mixed ages in one or more properties are accepted solely at our discretion.
12. TRAVEL INSURANCE It is The Renter's responsibility to ensure adequate travel insurance is purchased. By signing the rental agreement The Renter confirms that suitable travel insurance has been purchased to cover all members of the party. Alicante Holiday Villas Ltd, the owner of the property and the owner's keyholder do not accept any responsibility or liability whatsoever or howsoever caused for injury, illness, damage or loss to any of the travelling party as a result of failure to be adequately insured. Alicante Holiday Villas Ltd, the owner of the property and the owner's keyholder do not accept any responsibility or liability whatsoever or howsoever caused for injury, illness, damage or loss to any travelling party caused by use of the property, its facilities and communal facilities. Guests are required to exercise due supervision and care of children and the elderly when near swimming pools, balconies, stairs etc. Alicante Holiday Villas Ltd, the owner of the property and the owner's keyholder accept no responsibility for insurable risks.
13. FORCE MAJURE The owner of each property, the owner's keyholder and Alicante Holiday Villas Ltd will not be liable for any loss, injury or delay occasioned by any of the following: strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, industrial disputes, fire, flood, technical and/or weather problems with transport, aircraft grounding, flight cancellations, airline collapse, closure of ports or airports, weather conditions or any other event beyond the control of the owner of each property, the owner's keyholder and/or Alicante Holiday Villas Ltd.
14. PASSPORTS / VISAS It is The Renter's responsibility to ensure that all members of the travelling party have valid passports and, if applicable, visas.
15. BUILDING WORK All our holiday properties are situated in residential areas and work may begin on a neighbouring property over which we have no control, nor are we given prior notice. However, in any event, we will always do our best to inform you of the facts in advance but if this is not possible, Alicante Holiday Villas Ltd cannot be held responsible. As with most areas in Spain, there is on-going construction work in Gran Alacant. Where we believe this may affect the quality of your holiday we have included the relevant information in the property details.
16. COMMUNAL SWIMMING POOLS Swimming pools may close for parts of the day, may close for maintenance purposes or other reasons and may fully close during the winter months. Alicante Holiday Villas Ltd cannot and will not be held responsible should this happen during your stay. The management of swimming pools, their times of opening, usage rules and maintenance schedules are the responsibility of the local Community of Owners and as such is outside of the control of Alicante Holiday Villas Ltd, the owner and the owner's keyholder. The opening and closing times along with the rules of the pool are clearly displayed at the entrance to each swimming pool and you are expected to abide by these rules. Breach of the rules may result in pool access being denied to you. In the case of villas with private swimming pools it is The Renter's responsibilty to familiarise themselves with the pool, access and depths. Swimming pools can be dangerous places if not used correctly, especially for children. You are solely responsible for your own safety and that of the members of your party, guests and friends. We strongly advise that you purchase suitable travel insurance.
17. SATELLITE TELEVISION Only where stated in the property description, satellite television is included in the rental price. The packages may differ between properties depending on the system individual properties subscribe to. Channels may change or may become unavailable over which we have no control. Reception can be variable from time to time and may disappear completely for periods. This is usually due to weather conditions and is particularly so for UK channels as southern Spain is on the edge of the satellite footprint. From time to time the local supplier(s) may have to carry out maintenance resulting in complete loss of service. In all instances Alicante Holiday Villas Ltd cannot be held responsible for loss of service.
18. COMPLAINTS If, in the unlikely event, you have cause to complain, or have a problem with any aspect of the accommodation during your stay, you should, in the first instance, contact the keyholder responsible for the property in which you are staying within 24 hours. The keyholder will make every effort to resolve any complaint/problem that you may have. In the unlikely event that the keyholder cannot resolve your problem, you should either contact Alicante Holiday Villas Ltd by telephoning (0044) 208 150 6599 or request that the keyholder contacts us. We will endeavour to resolve your complaint/problem to your full satisfaction. Should we be unable to, you should make a written complaint, by email, to Alicante Holiday Villas within 7 days from the end of the rental period. We promise to respond within 10 working days. Any complaint not reported to the keyholder or to Alicante Holiday Villas Ltd at the time the problem occurs but only reported after The Renter's return home will not be considered valid. Alicante Holiday Villas Ltd cannot be held responsible for any temporary defect or malfunction of any appliance, equipment or machinery in the building, grounds or swimming pool. Under no circumstances shall our liability exceed the amount paid by The Renter for the rental period.
19. PROPERTY DESCRIPTIONS We take great care to ensure that each property is described correctly. Whilst we check each property at least twice a year, the owner may add or remove facilities without our knowledge. In the unlikely event this happens Alicante Holiday Villas Ltd cannot be held responsible. Walking and driving times are approximate and are based on our knowledge of the local area. We only quote walking times where it is reasonably practical to do so. Times to the beach are from the property to the beach car park / start of the beach road. The water's edge will be a few minutes further.
20. CONDUCT All properties on this website are located in residential areas. Please respect the privacy and quiet of the neighbourhood, keep noise to a minimum particularly after midnight, and abide by the rules relating to the use of the swimming pool, the communal facilities and the Urbanisation. In the event of any complaints which cause distress, danger or annoyance to any resident or other holidaymaker in adjoining properties, Alicante Holiday Villas Ltd reserve the right to terminate your holiday booking immediately. In this instance no refund will be due and no costs in locating alternative accommodation will be paid. Verbal and physical abuse of Alicante Holiday Villas staff, the owner's keyholder, residents or neighbours will not be tolerated and may result in the police being called.
21. RENTAL CONTRACT The rental contract that you sign is subject to English law and no other. If any dispute or claim cannot be resolved then any such dispute or claim must be dealt with by the Courts of England and Wales only.
